Faculty Senate Interpretation of Student Code of Academic Conduct and Judicial System
The University of Michigan-Dearborn Student Code of Academic Conduct and Judicial System was revised and the student rights and academic conduct provisions added to form the Statement of Student Rights and Code of Student Conduct in September 1994. Based on the experiences of the faculty in implementing the revised code, the following is the Faculty Senate's understanding of the academic conduct provisions of the Code:
1. University of Michigan-Dearborn students are expected to conduct themselves in a manner conducive to an environment of academic integrity and of respect for the educational process.
2. The faculty member has the right to give, at the beginning of the semester, fair notice of general and specific academic conduct expectations (for example, provide specific references in syllabus or other equivalent written announcements), to encourage the highest integrity on the part of students. The students shall adhere to both the general and specific expectations of the syllabus, as well as to the conduct expectations cited in the Code of Student Conduct.
3. When a student's academic conduct appears to violate the Code, the faculty member will informally indicate that concern and attempt to informally resolve the matter by action mutually agreed upon between the instructor and the student. If such agreement cannot be reached the faculty member may pursue one of the following courses of action:
(i) The faculty member may assign the student a course grade, including a failing grade, that the faculty member believes is appropriate in light of the alleged misconduct. Students may seek redress in accordance with the Statement and Code procedures.
(ii) In case of academic misconduct, if the faculty member is in doubt about what grade to assign, s(he) may, in consultation with the department chair, school dean or the ombudsperson, assign a grade of "NR" (or an interim grade) and file a complaint against the student. The complaint will be resolved in accordance with Code procedures. The faculty member will then assign the student a final grade appropriate to the resolution.
4. Every effort should be made to informally resolve academic conduct matters within the academic unit before an allegation of Code violation is initiated. Assistance may be sought from the unit Ombudsman or the Department Chair or both to informally resolve any disagreements between the student and the faculty member. Such informal resolution should be explored before the matter is brought before the Academic Affairs Proceedings Advisor and/or the Hearing Board.
5. Each academic unit shall develop its own adjudication route. Where the academic unit so chooses, the adjudication of the alleged academic violation may be handled in two distinct steps and by two separate bodies. One, the hearing board makes the determination of guilt or innocence in regard to the alleged violation; two, the sanction board imposes the appropriate sanction. Such separation may enhance the objectivity and independence of both the decisions.
